These Terms & Conditions govern the use of the Swapkiddies website, membership subscription and related services. By creating an account, purchasing a subscription or using our services, you agree to be legally bound by these Terms.

1. Definitions & Interpretations

Definitions & Interpretations

1.1 About these Terms

These Terms and Conditions (“Terms”) govern access to and use of the Swapkiddies Website, membership subscription, clothing-swapping service, SwapCoins system, online shop and any associated products, facilities, communications and services supplied by Swapkiddies.

By creating an Account, purchasing or renewing a Subscription, submitting Items, placing an Order, using SwapCoins or otherwise using any part of the Service, you agree to be legally bound by these Terms.

Please read these Terms carefully before using the Service. If you do not agree to these Terms, you must not create an Account, purchase a Subscription, submit Items, place an Order or otherwise use the Service.

Nothing in these Terms excludes, restricts or affects any rights or remedies that cannot lawfully be excluded or restricted under Applicable Law, including your statutory rights as a consumer.

 

​1.2 Definitions

In these Terms, the following words and expressions have the meanings set out below.

“Accepted Item”

means an Eligible Item submitted to Swapkiddies that:

a. falls within the age and product categories currently accepted by Swapkiddies;

b. has been received and inspected by Swapkiddies;

c. satisfies the Acceptance Standards in force at the time of inspection;

d. is considered by Swapkiddies, acting reasonably, to be safe, clean, reusable and suitable for circulation through the Service; and

e. has been formally recorded by Swapkiddies as accepted.

An Item does not become an Accepted Item merely because it has been delivered to, collected by or received by Swapkiddies.

“Acceptance Standards”

means the quality, cleanliness, condition, safety, labelling, category, age-range and other eligibility requirements applied by Swapkiddies when assessing submitted Items.

The Acceptance Standards may include requirements that Items are clean, dry, complete, hygienic, structurally sound and free from holes, tears, excessive wear, significant staining, mould, mildew, smoke odour, strong fragrances, pet hair, pests, bodily fluids, hazardous contamination, broken fastenings, sharp components, missing essential parts or other defects that make them unsuitable for reuse.

The Acceptance Standards may be explained in these Terms, on the Website, in the FAQs, in submission guidance or in other information issued by Swapkiddies.

“Account”

means the personal online account created by or for a Member to access and use relevant parts of the Service, including managing their Subscription, viewing Orders, submitting information, receiving communications and viewing or using their SwapCoin Balance.

“Account Holder”

means the individual whose name and details are registered to an Account and who is responsible for the Account and all activity carried out through it.

“Applicable Law”

means all laws, regulations, statutory instruments, regulatory requirements, codes, orders, judgments and legally binding rules applicable to Swapkiddies, the Member, the Contract, an Item, an Order or the Service from time to time.

This includes, where applicable, consumer-protection, product-safety, data-protection, electronic-commerce, intellectual-property, payment-services and distance-selling requirements in force in England and Wales and throughout the United Kingdom.

“Business Day”

means any day other than a Saturday, Sunday or public holiday in England on which banks in London are generally open for ordinary business.

“Cancellation Period”

means any statutory or contractual period during which a Consumer may have the right to cancel a Contract, as described in these Terms and required by Applicable Law.

“Child” or “Children”

means a baby or child whose clothing size ordinarily falls within the Service’s supported age range of birth to six years.

References to ages are general sizing guidance only. Clothing manufacturers may use different measurements and sizing systems, and the stated age on an Item does not guarantee that it will fit a particular child.

“Consumer”

means an individual acting for purposes wholly or mainly outside that individual’s trade, business, craft or profession.

“Content”

means all wording, photographs, graphics, illustrations, branding, logos, videos, designs, layouts, product information, software, databases, listings, documents and other materials appearing on or forming part of the Website or Service.

“Contract”

means the legally binding agreement between you and Swapkiddies arising when Swapkiddies accepts your application for a Subscription, accepts an Order or otherwise confirms the provision of a paid Service to you.

A separate Contract may arise in relation to each Subscription, renewal, Order or other transaction.

“Delivery Address”

means the postal address supplied by you and accepted by Swapkiddies for delivery of an Order or other communication or consignment.

“Delivery Partner”

means any independent postal operator, courier, logistics provider, collection service or other third party used by Swapkiddies or by a Member to transport, collect, return or deliver Items, parcels or Orders.

“Digital Communication”

means any email, Account notification, electronic message, Website notice, text message or other communication sent or made available electronically.

“Eligible Item”

means an Item that falls within a type, category and age range that Swapkiddies currently considers for acceptance.

Unless expressly stated otherwise by Swapkiddies, the Service is intended for clothing and approved textile Items for babies and Children aged from birth to six years.

Eligibility does not guarantee acceptance. Every submitted Item remains subject to inspection and the Acceptance Standards.

“Fees”

means all amounts payable in connection with the Service, including Subscription Fees, delivery charges and any other charges clearly disclosed before a transaction is completed.

“Force Majeure Event”

means an event or circumstance beyond the reasonable control of the affected party, including severe weather, natural disaster, fire, flood, epidemic, pandemic, war, terrorism, civil disturbance, industrial dispute, interruption to utilities or telecommunications, cyberattack, failure of transport networks, disruption affecting a Delivery Partner, governmental action or failure of essential suppliers.

“Intellectual Property Rights”

means all copyright, trade marks, service marks, trading names, business names, domain names, database rights, design rights, rights in software, rights in goodwill, rights to prevent passing off, confidential information rights and all other intellectual-property or proprietary rights, whether registered or unregistered, together with applications, renewals and extensions of those rights.

“Item”

means any garment, textile product, accessory or other article submitted, offered, displayed, processed, stored, supplied or ordered through the Service.

Use of the word “Item” does not mean that the article is eligible, accepted, safe, available, owned by Swapkiddies or approved for circulation.

“Member”

means an individual who:

a. is at least 18 years old;

b. has created or is authorised to use an Account;

c. has entered into a Contract with Swapkiddies where required; and

d. uses or has applied to use the Service.

Where the context requires, “Member” includes an Account Holder, Subscriber or customer.

“Membership”

means the status and access granted to a Member under a Subscription, subject to these Terms.

Membership is personal to the Member and must not be sold, transferred, shared or assigned except with Swapkiddies’ prior written approval.

“Membership Period”

means the period for which a Subscription remains active, beginning on the Subscription Start Date and continuing until it expires, is cancelled or is terminated in accordance with these Terms.

“Order”

means a request submitted through the Website for one or more available Items, products or services.

An Order does not become binding on Swapkiddies until it has been accepted or confirmed by Swapkiddies.

“Order Confirmation”

means the email, Account notification or other Digital Communication issued by Swapkiddies confirming that an Order has been accepted.

“Personal Data”

means any information relating to an identified or identifiable living individual, as understood under applicable data-protection law.

“Privacy Policy”

means the Swapkiddies privacy policy in force from time to time, explaining how Personal Data is collected, used, stored, shared and otherwise processed.

“Product Description”

means the description, photograph, category, size, condition information and other details displayed for an Item or product on the Website.

Product Descriptions are provided to assist Members but may contain reasonable variations, particularly because Items are pre-loved and clothing sizes, colours, fabrics and condition can vary.

“Prohibited Item”

means an Item that must not be submitted to or circulated through the Service.

Prohibited Items include:

a. footwear of any kind;

b. Items outside the supported age range or accepted product categories;

c. Items subject to a recall, safety warning, prohibition or withdrawal;

d. Items that are unlawful to possess, supply or distribute;

e. counterfeit, unauthorised replica or intellectual-property-infringing Items;

f. Items with holes, tears, unsafe damage or serious defects;

g. Items contaminated by mould, mildew, pests, bodily fluids, chemicals, smoke or hazardous substances;

h. Items presenting a choking, strangulation, entrapment, sharp-object, flammability or other reasonably identifiable safety risk;

i. Items whose required safety or care labelling has been deliberately removed or altered;

j. Items that Swapkiddies reasonably considers unsuitable, unsafe, unhygienic or inappropriate for circulation; and

k. any other Item identified as prohibited in these Terms or on the Website.

“Rejected Item”

means an Item that Swapkiddies does not accept following inspection or assessment.

An Item may be rejected because it is ineligible, unsuitable, unsafe, unhygienic, excessively worn, damaged, incomplete, prohibited, outside the supported age range, inconsistent with the Acceptance Standards or otherwise unsuitable for the Service.

Rejected Items do not qualify for SwapCoins.

Subject to Applicable Law and these Terms, Rejected Items will not ordinarily be returned to the Member and may instead be donated, reused for community or nursery purposes, responsibly recycled, repurposed or disposed of.

“Renewal Date”

means the date on which a recurring Subscription is scheduled to renew and the next Subscription Fee becomes payable, unless the Subscription has been cancelled or otherwise ended.

“Service”

means the services operated or supplied by Swapkiddies from time to time, including:

a. the Website and Account facilities;

b. Membership and Subscription services;

c. the submission, receipt, assessment and processing of Items;

d. the SwapCoins reward system;

e. the display and supply of pre-loved children’s clothing;

f. ordering, packing, delivery and customer-support services; and

g. any related features, communications, promotions or facilities.

The Service may be updated, modified, suspended, replaced or withdrawn in accordance with these Terms and Applicable Law.

“Service Area”

means the geographic area in which Swapkiddies currently accepts Members, collections, Item submissions or Orders.

The Service Area may depend on Delivery Partner availability and may be changed by Swapkiddies from time to time.

“Subscriber”

means a Member who has purchased and maintains an active Subscription.

“Subscription”

means the recurring paid membership arrangement under which a Member receives access to specified features of the Service for a Subscription Fee.

Unless otherwise stated at the time of purchase, the Subscription renews monthly until cancelled or terminated in accordance with these Terms.

“Subscription Fee”

means the recurring amount payable for the Subscription, as displayed on the Website and confirmed before purchase.

“Subscription Start Date”

means the date on which Swapkiddies confirms that the Subscription has started.

“Submitted Item”

means any Item sent, delivered, collected, transferred or otherwise provided to Swapkiddies for assessment, whether or not the Item is later accepted.

“SwapCoin”

means a non-cash, promotional reward unit issued and administered by Swapkiddies under these Terms.

SwapCoins:

a. may be awarded only for Accepted Items or through another promotion expressly authorised by Swapkiddies;

b. may be used only within the Swapkiddies Service in the manner permitted by Swapkiddies;

c. are not money, electronic money, cryptocurrency, a bank deposit, a security or a stored monetary balance;

d. have no cash-redemption value;

e. cannot be withdrawn, exchanged for cash or used outside the Service;

f. cannot be sold, traded, gifted or transferred between Members unless Swapkiddies expressly introduces a feature permitting this;

g. remain subject to validation, correction, cancellation and expiry under these Terms; and

h. do not give a Member any ownership interest in Swapkiddies or in any particular Item.

“SwapCoin Balance”

means the number of valid SwapCoins recorded by Swapkiddies as available within a Member’s Account.

Swapkiddies’ internal records will determine the SwapCoin Balance, subject to correction of any manifest or technical error.

“SwapCoin Value”

means the number of SwapCoins required to obtain a particular Item through the Service, or the number of SwapCoins awarded for an Accepted Item.

SwapCoin Value may be determined by Swapkiddies using factors such as Item type, size, condition, seasonality, quality, likely reuse, operational costs, demand and availability.

Brand name alone does not determine whether an Item will be accepted or its SwapCoin Value.

“SwapCoins Scheme”

means the reward programme through which eligible Members may receive and use SwapCoins subject to these Terms.

“Terms”

means these Terms and Conditions, together with any documents expressly incorporated into them by reference, as updated from time to time.

“United Kingdom” or “UK”

means England, Wales, Scotland and Northern Ireland.

“Website” or “Site”

means the website operated under the Swapkiddies name, including swapkiddies.com, its webpages, Account areas, online shop and any replacement or successor website operated by Swapkiddies.

Writing” or “Written”

includes communication by email and other Digital Communication, unless these Terms expressly require a signed physical document.

“Swapkiddies”, “we”, “us” or “our”

means Swapkiddies Ltd, a company registered in England and Wales under company number 16704157, whose registered office is at 60 Tottenham Court Road, Suite 6522a, Fitzrovia, London, W1T 2EW.

“you” or “your”

means the person accessing the Website, creating or using an Account, purchasing a Subscription, submitting an Item, placing an Order or otherwise using the Service.

Where an Account is used on behalf of another person, “you” includes the Account Holder and any person using the Account with or without the Account Holder’s permission, to the extent permitted by Applicable Law.

1.3 Interpretation

Unless the context requires otherwise:

a. words in the singular include the plural, and words in the plural include the singular;

b. references to one gender include all genders;

c. references to a “person” include an individual, company, partnership, organisation, public body or other legal or commercial entity;

d. the words “including”, “include”, “in particular”, “for example” and similar expressions are illustrative and do not limit the words preceding them;

e. references to a statute, regulation or other legal provision include that provision as amended, extended, re-enacted or replaced from time to time, together with any subordinate legislation made under it;

f. references to a Section, clause or paragraph are references to a section, clause or paragraph of these Terms unless stated otherwise;

g. headings are included for convenience and readability only and do not affect the legal interpretation of these Terms;

h. an obligation not to do something includes an obligation not to permit, assist, encourage or attempt that act;

i. where these Terms give Swapkiddies discretion, that discretion will be exercised reasonably and in accordance with Applicable Law;

j. where a time period is stated in days, calendar days are meant unless Business Days are expressly specified;

k. if an obligation falls due on a day that is not a Business Day, it may be performed on the next Business Day unless Applicable Law requires otherwise;

l. any reference to an Item being “safe”, “approved”, “accepted” or “checked” means that Swapkiddies has applied its reasonable inspection process. It does not amount to a manufacturer’s guarantee or a representation that an Item is new, flawless or suitable for every Child;

m. references to a Child’s age are general indicators of the intended clothing category and do not guarantee fit, development stage, suitability or measurements;

n. any examples of unacceptable or prohibited Items are non-exhaustive;

o. information displayed on the Website, in the FAQs or in Member guidance may supplement these Terms but will not override them unless Swapkiddies expressly states that it forms part of the Contract;

p. if there is an inconsistency between these Terms and promotional material, these Terms will prevail, except where the promotional statement has expressly been incorporated into the Contract or Applicable Law requires otherwise; and

q. no provision of these Terms will be interpreted as excluding or restricting liability, rights or remedies where doing so would be unlawful.

1.4 Documents forming part of the Contract

These Terms should be read together with the following documents, where applicable:

a. the Privacy Policy;

b. the Cookie Policy;

c. the Shipping and Delivery Policy;

d. the Returns and Refunds Policy;

e. the Subscription information displayed at checkout;

f. the Acceptance Standards and Item-submission guidance;

g. the SwapCoins rules displayed on the Website;

h. any Order Confirmation; and

i. any additional terms expressly accepted by you in connection with a particular promotion, feature or service.

Where a separate policy conflicts with these Terms, these Terms will take priority unless the separate policy expressly states that it overrides a particular provision or Applicable Law requires a different result.

 

1.5 No waiver of statutory rights 

Nothing in these Terms is intended to deprive a Consumer of rights or remedies provided by Applicable Law.

If any provision of these Terms conflicts with a mandatory legal right, the mandatory legal right will apply to the extent of the conflict, and the remaining provisions of these Terms will continue to apply.

Eligibility & Membership

2. Eligibility & Membership

2.1 Eligibility

Swapkiddies is a membership-based clothing swapping service designed exclusively for pre-loved clothing and accessories for babies and children aged 0 to 6 years.

To become a Member and use the Services, you must:

a. be at least 18 years of age;

b. have the legal capacity to enter into a binding contract;

c. provide accurate, complete and up-to-date registration information;

d. maintain a valid payment method for your Subscription;

e. comply with these Terms at all times.

The Services are intended for personal, non-commercial use only. Businesses, commercial resellers, charities, retailers or any person using the Service for commercial purposes may not register or participate without our prior written consent.

We reserve the right to refuse Membership where we reasonably believe an applicant does not satisfy these eligibility requirements.

2.2 Membership Subscription

Access to the Swapkiddies Service requires an active paid Membership Subscription.

Membership provides access to the Swapkiddies clothing-swapping platform, including the ability to submit eligible clothing for assessment, receive SwapCoins for Accepted Items, and redeem SwapCoins towards eligible clothing available through the Service, subject always to these Terms.

Membership benefits apply only while a Subscription remains active and fully paid.

Failure to maintain an active Subscription may result in suspension or restriction of certain Services until payment has been successfully received.

2.3 Membership Accounts and Account Misuse

A person may create only one Membership Account unless expressly authorised by Swapkiddies.

Members must not create or operate multiple Accounts for the purpose of:

  • obtaining duplicate promotional offers or Membership benefits;

  • avoiding account restrictions or enforcement action;

  • manipulating the SwapCoins system;

  • providing false or misleading information; or

  • otherwise abusing the Service.

Where Swapkiddies reasonably believes that multiple Accounts have been created or used in breach of these Terms, we reserve the right to suspend, merge or permanently close those Accounts and remove any improperly obtained SwapCoins or Membership benefits.

Legitimate separate Memberships held by different individuals, including members of the same household, are permitted, provided each Membership complies with these Terms.

2.4 Membership Is Personal

Membership is personal to the registered Member.

Members may not:

  • transfer their Membership;

  • sell their Membership;

  • lend their Membership to another person;

  • allow another person to access or use their Account; or

  • share login credentials with anyone else.

Any activity carried out using a Member's Account shall be treated as having been authorised by that Member unless proven otherwise.

2.5 Renewal of Membership

Subscriptions renew automatically at the end of each billing period unless cancelled before the next renewal date.

By purchasing a Subscription, the Member authorises Swapkiddies to collect recurring Subscription payments using the payment method stored on the Account.

Members are responsible for ensuring that their payment information remains valid and up to date.

2.6 Suspension of Membership

Swapkiddies may suspend a Membership immediately where we reasonably believe that a Member has:

  • breached these Terms;

  • supplied false or misleading information;

  • attempted to manipulate the SwapCoins system;

  • repeatedly submitted unsuitable items;

  • abused our staff or other Members;

  • used the Service fraudulently or unlawfully; or

  • otherwise acted in a manner likely to damage Swapkiddies, its Members or the integrity of the Service.

During any suspension, access to some or all Services may be restricted.

2.7 Termination of Membership

Members may cancel their Subscription at any time through their Account.

Cancellation prevents future renewal payments but does not automatically entitle the Member to a refund for the current Subscription period unless required by Applicable Law or expressly stated within these Terms.

Swapkiddies may terminate a Membership immediately where there has been a serious or repeated breach of these Terms.

Termination of Membership does not affect any rights or obligations which arose before the date of termination.

2.8 No Guarantee of Continued Membership

Swapkiddies reserves the right to refuse, suspend or terminate Membership where reasonably necessary to:

  • protect the integrity of the Service;

  • investigate suspected fraud;

  • comply with legal obligations;

  • protect other Members; or

  • safeguard the reputation and operation of Swapkiddies.

Such decisions shall be made acting reasonably and in accordance with Applicable Law.

2.9 Changes to Membership Benefits

Swapkiddies may introduce, remove or amend Membership features, benefits or Services from time to time.

Where changes materially affect Members, reasonable notice will be provided where practicable.

Continued use of the Service following such changes constitutes acceptance of the updated Membership benefits.

2.10 Children's Clothing Scope

Swapkiddies exclusively accepts clothing and approved accessories intended for babies and children aged 0 to 6 years.

Items intended for older children or adults fall outside the scope of the Service and will not qualify for assessment or SwapCoins.

Acceptance of any item remains subject to the eligibility requirements contained in these Terms.

Member Accounts

3. Member Accounts

3.1 Creating an Account

To access the Services, a user must create a Swapkiddies Member Account.During registration, Members must provide accurate, complete and up-to-date information, including a valid email address and any other information reasonably requested by Swapkiddies.Members are responsible for ensuring that their Account information remains accurate at all times and must promptly update any changes through their Account settings or by contacting Swapkiddies. Swapkiddies reserves the right to refuse the creation of any Account where we reasonably believe that the information provided is inaccurate, misleading, fraudulent or otherwise inconsistent with these Terms.

 

3.2 Account Security

Members are responsible for maintaining the confidentiality of their login credentials, including their password. Members must take reasonable steps to prevent unauthorised access to their Account and must notify Swapkiddies immediately if they become aware of any suspected unauthorised access, security breach or misuse of their Account. Members remain responsible for all activity carried out through their Account unless they have notified Swapkiddies of unauthorised use without unreasonable delay.

 

3.3 Responsibility for Account Activity

All activity carried out through a Member Account is deemed to have been authorised by the registered Member unless proven otherwise. Members are responsible for all Orders, Item submissions, communications, SwapCoin transactions and other activity carried out using their Account. Members must ensure that all information submitted through their Account is truthful, accurate and complies with these Terms.

 

3.4 Account Verification

Swapkiddies may request additional information or documentation to verify a Member's identity or eligibility where reasonably necessary to:

a. protect the integrity of the Service;

b. investigate suspected fraud;

c. comply with legal obligations;

d. verify ownership of an Account; or

e. resolve disputes.

Failure to provide requested information within a reasonable period may result in temporary suspension or closure of the Account.

 

3.5 Updating Account Information

Members are responsible for keeping their contact details, delivery address and payment information accurate and up to date. Swapkiddies shall not be responsible for delays, failed deliveries, missed communications or other losses arising from inaccurate or outdated information provided by a Member.

 

3.6 Closing Your Account

Members may close their Account at any time by following the Account closure process or by contacting Swap kiddies. Closing an Account does not automatically cancel an active Membership Subscription, which must be cancelled separately in accordance with these Terms. Account closure does not affect any rights or obligations that arose before the Account was closed.

 

3.7 Account Suspension or Restriction

Swapkiddies may temporarily restrict or suspend access to a Member Account where reasonably necessary to: investigate suspected breaches of these Terms; investigate suspected fraud or unlawful activity; protect the security of the Service; protect other Members; comply with legal obligations; or maintain the integrity of the Swapkiddies platform. Where reasonably practicable, we will notify the Member of the suspension and the reasons for it.

 

3.8 Closed Accounts

Where an Account is permanently closed: access to the Account will cease; Membership benefits will end unless otherwise required by Applicable Law; access to previous Orders, submissions and Account features may no longer be available; SwapCoins will be dealt with in accordance with Section 8 (SwapCoins).

Subscription, Fee & Cancellations

4. Subscription, Fees & Cancellations 

4.1 Requirement for an Active Subscription

Access to the Swapkiddies clothing swapping Service requires an active, paid Membership Subscription. A Member may create an Account before purchasing a Subscription, but the Member may not use subscription-only features unless and until:

a. the applicable Subscription has been purchased;

b. the first Subscription payment has been successfully received; and

c. the Subscription has become active.

Subscription-only features may include submitting Items for assessment, receiving SwapCoins for Accepted Items, redeeming SwapCoins, placing eligible Orders and accessing any other benefits identified as part of the Membership. A Subscription applies only to the individual Member Account through which it was purchased and may not be transferred, shared or used through another Account.

 

4.2 Subscription Price

Unless otherwise clearly stated at the time of purchase, the standard Swapkiddies Membership Subscription costs £20 per month. The total recurring Subscription price, the billing frequency and any other mandatory charges will be displayed before the Member confirms the purchase. The Subscription price is inclusive of VAT where VAT is applicable. Unless expressly stated otherwise, the Subscription price does not include:

a. delivery, postage or collection charges;

b. charges relating to individual Orders;

c. optional products or services;

d. replacement, redelivery or administration charges properly incurred under these Terms; or

e. any other charge clearly disclosed to the Member before the relevant transaction is confirmed.

No additional optional charge will be imposed without the Member’s express agreement.

 

4.3 Payment Authorisation

By purchasing a Subscription, the Member authorises Swapkiddies and its appointed payment-service provider to charge the selected payment method:

a. when the Subscription is first purchased; and

b. automatically at the beginning of each subsequent monthly billing period until the Subscription is cancelled or terminated. The Member confirms that they are authorised to use the payment method supplied. The Member is responsible for ensuring that all payment and billing information remains accurate, valid and up to date. Payments may be processed by a third-party payment provider.  Swapkiddies does not necessarily receive or retain the Member’s complete payment-card details.

 

4.4 Automatic Monthly Renewal

The Subscription operates on an automatically renewing monthly basis. Unless cancelled before the next renewal payment is processed, the Subscription will automatically renew for a further monthly billing period and the applicable Subscription fee will be charged to the Member’s registered payment method. The Member’s renewal date will normally correspond with the date on which the Subscription was first activated, subject to payment-processing times and any adjustment clearly notified to the Member. Automatic renewal continues until:

a. the Member cancels the Subscription;

b. Swapkiddies terminates the Subscription in accordance with these Terms; or

c. the Subscription ends for another reason permitted by these Terms or Applicable Law. A Member is not required to remain subscribed for a minimum number of months unless a separate promotional offer expressly and clearly states otherwise before purchase.

 

4.5 When Membership Benefits Begin

Membership benefits normally begin once the initial Subscription payment has been successfully processed and the Subscription is shown as active. Where a Member asks Swapkiddies to begin supplying the Service during a statutory cancellation period, the Member expressly requests immediate performance of the Service. The Member understands that, where permitted by law, cancelling after the Service has begun may entitle Swapkiddies to retain or recover a proportionate amount for Services already supplied before cancellation. Nothing in this clause limits any statutory right that cannot lawfully be excluded or restricted.

 

4.6 Fourteen-Day Statutory Cancellation Right

Where the Member enters into the Subscription online or otherwise at a distance, the Member may have a statutory right to cancel the initial Subscription within 14 days beginning on the day after the contract is entered into. The Member may exercise that right by making a clear statement that they wish to cancel. No particular wording is required. Cancellation may be requested through any cancellation facility made available in the Member’s Account or by contacting Swapkiddies using the contact details published on the Website. Where the Member cancels during the statutory cancellation period:

a. Swapkiddies will provide any refund required by Applicable Law;

b. if the Member expressly requested that the Service begin during that period, Swapkiddies may deduct a lawful and proportionate amount for the Service supplied before cancellation;

c. the Member may lose access to Membership benefits when the cancellation takes effect; and

d. any Items, Orders or SwapCoin activity already undertaken will be dealt with in accordance with these Terms and Applicable Law.

This statutory right is separate from the Member’s ordinary right to stop future monthly renewals under clause 4.7. The existing Consumer Contracts Regulations generally provide a 14-day cancellation period for a distance service contract and permit proportionate payment where the consumer expressly requested early performance.

 

4.7 Cancelling Future Renewals

Members may cancel their Subscription at any time through their Member Account or by contacting Swapkiddies.

Cancellation prevents future renewal payments only.

Where a Member cancels their Subscription:

a. the current Subscription will remain active until the end of the billing period already paid for;

b. no further monthly Subscription fee will be charged unless the Member subscribes again;

c. the Member will continue to enjoy all Membership benefits until the expiry of the current paid Subscription period; and

d. Membership access will automatically end once that paid Subscription period expires.

Example:

If a Subscription begins on 5 July and is cancelled on 12 July, the Member will continue to have full Membership access until 5 August, after which the Membership will end unless renewed.

Once the Membership has expired, access to Member-only features will be suspended until a new Subscription is purchased.

 

4.8 Refunds Following Ordinary Cancellation

Except where required by Applicable Law or expressly stated in these Terms, Subscription fees are not refundable merely because:

a. the Member changes their mind after the statutory cancellation period;

b. the Member does not use the Service;

c. the Member submits no Items during a billing period;

d. no submitted Items are accepted;

e. the Member does not redeem their SwapCoins;

f. the Member forgets to cancel before a monthly renewal; org. the Member chooses to stop using the Service before the paid billing period ends. Swapkiddies may, at its discretion, provide a refund, credit or other goodwill remedy. Doing so on one occasion does not create an obligation to do so again. Nothing in this clause affects any refund or remedy to which a Member is legally entitled.

 

4.9 Failed, Declined or Reversed Payments

Where a Subscription payment is declined, fails, is reversed or cannot be collected, Swapkiddies may:

a. attempt to process the payment again;

b. ask the Member to provide an alternative payment method;

c. temporarily restrict or suspend Membership benefits;

d. prevent the Member from submitting Items, placing Orders or redeeming SwapCoins;

e. cancel the Subscription; or

f. recover any properly due and outstanding amount.

Where reasonably practicable, Swapkiddies will notify the Member and provide a reasonable opportunity to update their payment information. A Member remains responsible for any Subscription fee that became properly due before cancellation or termination. Swapkiddies will not impose an undisclosed charge solely because a payment has failed. Any lawful charge associated with a failed payment must be reasonable and clearly communicated.

 

4.10 Chargebacks and Payment Disputes

A Member should contact Swapkiddies promptly if they do not recognise a payment or believe that an incorrect amount has been charged. A Member must not knowingly initiate a false, dishonest or abusive chargeback. Where a chargeback or payment reversal is initiated, Swapkiddies may temporarily suspend the relevant Account while the matter is investigated. If the payment dispute is resolved in Swapkiddies’ favour, the Member remains responsible for the original properly due amount and any reasonable direct cost lawfully recoverable from the Member. Nothing in this clause prevents a Member from disputing an unauthorised, incorrect or unlawful charge with their payment provider or exercising any statutory right.

 

4.11 Subscription Price Changes

Swapkiddies may change the Subscription price from time to time. Any change will not alter a monthly Subscription fee that has already been paid for the current billing period. Before a higher price is applied to an existing Subscription, Swapkiddies will provide clear and reasonable advance notice stating:

a. the new price;

b. the date on which it will take effect; and

c. how the Member may cancel before being charged the new price.

Where required by Applicable Law, Swapkiddies will obtain the Member’s express agreement before applying the change. If the Member does not wish to continue at the new price, they may cancel before the first renewal at that price. Continued use after a price change will constitute acceptance only where that treatment is lawful and the Member received adequate notice and a genuine opportunity to cancel.

 

4.12 Promotional Prices, Discounts and Trials

Swapkiddies may occasionally offer promotional prices, discounts, introductory offers or trial periods. Any special conditions, including eligibility, duration, price and what happens at the end of the promotional period, will be clearly disclosed before the Member accepts the offer. Unless the offer states otherwise:

a. it may be limited to new Members or one use per eligible person;

b. it may not be exchanged for cash or transferred;

c. it may not be combined with another offer;

d. Swapkiddies may refuse or withdraw an offer obtained through fraud, duplication or misuse; and

e. an automatically renewing paid Subscription will begin after the promotion or trial only where that consequence was clearly disclosed and validly agreed. Before any free or reduced-price period converts into a paid Subscription, Swapkiddies will provide any notice required by Applicable Law.

 

4.13 No Suspension or Pausing of Membership

Unless Swapkiddies expressly provides a pause feature, a Subscription cannot be temporarily frozen or paused. A Member who no longer wishes to pay the monthly Subscription fee must cancel the Subscription. If the Member later wishes to return, they may purchase a new Subscription, subject to the prices, availability and Terms applying at that time. Swapkiddies does not guarantee that previous promotional pricing or benefits will remain available following cancellation.

 

4.14 Effect of Subscription Expiry or Cancellation

When a Membership Subscription expires or is cancelled:

a. access to Member-only Services will end;

b. new Item submissions cannot be made;

c. new Orders cannot be placed;

d. existing Orders already accepted by Swapkiddies will continue to be processed in accordance with these Terms;

e. the Member Account will remain open unless separately deleted;

f. previously earned SwapCoins will remain stored on the Member's Account in accordance with Section 8; and

g. the Member may reactivate their Membership at any time by purchasing a new Subscription.

 

4.15 Termination by Swapkiddies

Swapkiddies may cancel or terminate a Subscription where permitted under these Terms, including where the Member:

a. fails to pay an amount properly due;

b. commits a material or repeated breach of these Terms;

c. acts fraudulently, dishonestly or unlawfully;

d. misuses the Account, Service or SwapCoins system;

e. submits prohibited, unsafe, stolen or knowingly unsuitable Items;

f. threatens, abuses or harasses staff, contractors or other persons connected with the Service; org. creates a material risk to Swapkiddies, its Members or the operation of the Service. Where the breach can reasonably be remedied, Swapkiddies may provide the Member with an opportunity to correct it before termination. Immediate suspension or termination may be used where reasonably necessary to prevent fraud, unlawful conduct, harm, a serious safety risk or significant misuse. Any refund following termination will depend on the reason for termination, Services already supplied and Applicable Law.

 

4.16 Discontinuing the Subscription Service

Swapkiddies may discontinue the Subscription Service or a material part of it for legitimate business, operational, legal or regulatory reasons. Where reasonably practicable, Members will receive reasonable advance notice. If Swapkiddies ends a paid Subscription before the end of a billing period for reasons unrelated to the Member’s breach, Swapkiddies will provide any appropriate proportionate refund or alternative remedy required by Applicable Law.

 

4.17 Statutory Rights

Nothing in this Section excludes, restricts or otherwise affects a Member’s statutory consumer rights.Where any provision of this Section conflicts with a mandatory right under Applicable Law, the mandatory legal right will prevail.

Clothing Submission & Acceptance

5. Clothing Submission & Acceptance 

5.1 Submitting Clothing

Members with an active Membership Subscription may submit eligible clothing and approved accessories for assessment through the Swapkiddies Service. All Items must be submitted in accordance with these Terms, any submission instructions provided by Swapkiddies and any reasonable packaging or delivery requirements communicated to Members. Submitting an Item does not guarantee that it will be accepted into the Service or that SwapCoins will be awarded. Members are responsible for ensuring that all submitted Items belong to them, that they have the legal right to transfer ownership of those Items if accepted, and that the Items are free from any third party ownership claims, security interests or legal restrictions.

 

5.2 Eligible Clothing

Swapkiddies accepts preloved clothing intended for babies and children aged 0 to 6 years.To be eligible for assessment, an Item must:

a. fall within the accepted age range;

b. be genuine and lawfully owned by the Member;

c. comply with applicable product safety requirements;

d. meet the quality and condition standards determined by Swapkiddies; and

e. not fall within any prohibited category described in these Terms.

Acceptance of a particular Item is always subject to assessment and remains entirely at Swapkiddies' discretion.

 

5.3 Clothing Condition Standards

Members must submit only Items that are clean, freshly laundered, hygienic and ready for immediate use. Items should be in excellent second hand condition, showing only reasonable signs of previous wear appropriate for children's clothing.

Without limitation, Items may be rejected where they contain:

a. stains or discolouration;

b. holes, tears or fabric damage;

c. broken zips, poppers, fasteners or missing buttons;

d. excessive fading, stretching or shrinkage;

e. strong odours, including smoke, mould or mildew;

f. excessive pet hair;

g. visible pilling or excessive wear;

h. damaged prints, embellishments or decorations; or

i. any condition that, in Swapkiddies' reasonable opinion, makes the Item unsuitable for resale or swapping.

Minor signs of careful use do not automatically prevent acceptance where the overall quality remains consistent with Swapkiddies' standards.

 

5.4 Clothing Assessment

Every submitted Item will be individually inspected by Swapkiddies before any SwapCoins are awarded.

During assessment, Swapkiddies may consider factors including:

a. condition;

b. cleanliness;

c. safety;

d. authenticity where relevant;

e. demand;

f. resale suitability;

g. seasonal relevance; and

h. compliance with these Terms.

Swapkiddies may accept, reject or assign a SwapCoin value to any Item acting reasonably and in accordance with its assessment criteria. Assessment outcomes are final unless an obvious administrative error has occurred.

 

5.5 Award of SwapCoins

Every Item accepted by Swapkiddies is awarded one (1) SwapCoin.

SwapCoins are awarded only after an Item has successfully passed assessment and has been accepted by Swapkiddies.

Each accepted Item has the same SwapCoin value regardless of its brand, original retail price or perceived market value.

SwapCoins may only be used in accordance with these Terms and have no cash value.

 

5.6 Ownership of Accepted Clothing

Ownership of any Item accepted by Swapkiddies transfers to Swapkiddies immediately upon acceptance and the award of the applicable SwapCoin.

Once ownership has transferred, the Member no longer has any ownership rights in the accepted Item and cannot request its return.

Swapkiddies may photograph, prepare, store, advertise, exchange, donate, recycle, sell or otherwise deal with accepted Items as part of operating the Service.

 

5.7 Rejected Clothing

Where an Item does not meet Swapkiddies' acceptance criteria, it will not be accepted into the Service and no SwapCoin will be awarded for that Item.

Members should submit only Items that they no longer wish to have returned.

By sending Items to Swapkiddies, the Member acknowledges and agrees that any Item which is not accepted into the Service will not be returned.

Rejected Items may, at Swapkiddies' sole discretion, be donated to a registered charity, reused for educational or community purposes, responsibly recycled or otherwise disposed of in an environmentally responsible manner. Swapkiddies is under no obligation to identify individual rejected Items, provide photographs, explain individual assessment decisions or return rejected Items to the Member.

The number of SwapCoins credited to the Member's Account represents the total number of Items accepted by Swapkiddies following assessment. This policy enables Swapkiddies to minimise unnecessary transportation, reduce environmental impact and support its commitment to promoting the reuse of children's clothing wherever reasonably possible.

5.8 Hygiene and Safety Requirements

Members must not submit any Item that may present a health, hygiene or safety risk.All Items must be clean, dry and free from contamination. Swapkiddies may immediately reject or safely dispose of any Item that, in its reasonable opinion, presents a hygiene, safety or legal risk to staff, Members or the Service.

 

5.9 Prohibited Items

Without limitation, Members must not submit:

a. counterfeit or imitation goods;

b. illegal or stolen Items;

c. Items containing mould, mildew or infestation;

d. Items that present a hygiene or safety risk;

e. damaged, heavily soiled or contaminated Items; or

f. any Item prohibited by Applicable Law.

Swapkiddies may amend this list from time to time where reasonably necessary.

This now reflects exactly what Swapkiddies accepts and doesn't include categories you don't deal with.

5.10 Acceptance Decisions

Acceptance decisions remain entirely at Swapkiddies' discretion, exercised reasonably and consistently. Previous acceptance of a similar Item does not guarantee future acceptance. Swapkiddies may amend its acceptance standards from time to time to reflect customer demand, operational requirements, safety standards, legal obligations or business needs.

Orders, SwapCoins & Purchasing Clothing

6. Orders, SwapCoins & Purchasing Clothing 

6.1 Using SwapCoins

SwapCoins may only be used by Members with an active Membership Subscription to obtain eligible Items through the Swapkiddies Service. SwapCoins may only be redeemed in accordance with these Terms and have no cash value. SwapCoins cannot be exchanged for money, transferred to another Member or redeemed outside the Swapkiddies platform.

 

6.2 Available Clothing

All Items available through the Swapkiddies Service are offered subject to availability. As most Items are unique secondhand garments, only one of each Item will generally be available unless otherwise stated.

Availability changes frequently and all Items are offered on a first come, first served basis. The inclusion of an Item on the Website does not guarantee that it will remain available until an Order is completed.

 

6.3 Placing an Order

A Member may place an Order by selecting available Items and completing the online checkout process using the required number of SwapCoins together with payment of any applicable delivery charges.

Submission of an Order does not itself guarantee acceptance.  An Order is accepted only when successfully processed by Swapkiddies.

 

6.4 Deduction of SwapCoins

The required number of SwapCoins will be deducted from the Member's Account when the Order is successfully completed during checkout.

Once an Order has been successfully completed, the relevant Items will no longer be available for selection by other Members.

Where an Order cannot be completed because of a technical error or another reason for which Swapkiddies is responsible, any deducted SwapCoins will be restored to the Member's Account as soon as reasonably practicable.

6.5 Order Acceptance

Swapkiddies reserves the right to refuse, cancel or amend an Order before dispatch where reasonably necessary, including where:

a. an Item is no longer available;

b. a stock, listing or technical error has occurred;

c. fraud or misuse is reasonably suspected;

d. delivery payment cannot be processed; or

e. fulfilment is prevented by circumstances beyond Swapkiddies' reasonable control.

Where an Order cannot be fulfilled, Swapkiddies will restore any deducted SwapCoins and, where applicable, refund any delivery charge paid.

 

6.6 Order Quantities

There is no general limit on the number of Items a Member may order, provided sufficient SwapCoins are available.

However, Swapkiddies reserves the right to reasonably limit unusually large Orders where necessary for operational reasons, stock availability or to ensure fair access to the Service for all Members.

6.7 Delivery Charges

Each Order is subject to a flat delivery charge of £4.99, payable during checkout.

Where the actual delivery cost exceeds £4.99, Swapkiddies will bear the additional cost unless a different delivery charge has been clearly communicated before the Member completes the Order.

Delivery charges are separate from Membership fees and the use of SwapCoins.

 

6.8 Dispatch and Delivery

Swapkiddies will use reasonable efforts to dispatch Orders promptly after they have been accepted.

Estimated delivery times are provided for guidance only and are not guaranteed. Delays caused by postal operators, couriers or circumstances outside Swapkiddies' reasonable control shall not constitute a breach of these Terms.

Members are responsible for providing accurate delivery information. Swapkiddies shall not be responsible for delays or failed deliveries resulting from inaccurate or incomplete address details supplied by the Member.

 

6.9 Risk and Ownership

Ownership of Items transfers to the Member upon delivery of the Order.

Risk of loss or damage also passes to the Member upon successful delivery to the address provided during checkout.

6.10 Problems with an Order

Members should inspect their Order promptly upon delivery.

If a Member believes that an Order contains an incorrect Item, a missing Item, an Item that has been significantly damaged during delivery or another fulfilment error, the Member should contact Swapkiddies within seven (7) days of delivery.

Swapkiddies will investigate the matter and, where appropriate, may provide a suitable remedy, including replacement (where available), restoration of SwapCoins or another reasonable solution.

6.11 Preloved Clothing

Members acknowledge that all Items supplied through Swapkiddies are preloved children's clothing.

Normal signs of careful previous use that are consistent with the quality standards described in Section 5 do not constitute defects.

Members should not expect Items to be in brand new condition.

 

6.12 Product Images and Descriptions

Swapkiddies makes reasonable efforts to accurately photograph and describe each Item.

However, colours, textures and appearance may vary due to lighting, photography, monitor settings or mobile device displays.

Minor differences between photographs and the Item received shall not constitute a defect.

 

6.13 Shopping Basket

Adding an Item to a shopping basket does not reserve that Item.

Items remain available to other Members until an Order has been successfully completed.

 

6.14 Lost or Delayed Deliveries

Where Swapkiddies dispatches an Order to a Member and the parcel is reasonably believed to have been lost during delivery, Swapkiddies will investigate the matter with the relevant delivery provider.

Where appropriate, Swapkiddies may restore the relevant SwapCoins to the Member's Account or provide another reasonable remedy.

Members sending Items to Swapkiddies remain responsible for those Items until they have been successfully delivered to Swapkiddies.

 

6.15 Returning Unwanted Items

A Member who no longer wishes to keep an Item obtained through the Service may submit that Item to Swapkiddies as a new clothing submission.

Returned Items will be assessed in accordance with Section 5 in the same manner as any other submitted Item.

Acceptance is not guaranteed. Where a returned Item is accepted, the Member will receive one (1) SwapCoin for that Item. Where a returned Item does not satisfy the acceptance criteria, it will be treated as a rejected Item in accordance with Section 5.

 

6.16 Operational Changes

Swapkiddies may make reasonable changes to ordering procedures, delivery arrangements or operational processes where necessary to improve the Service, comply with legal obligations or respond to business requirements.

Such changes will not affect completed Orders unless required by Applicable Law.

 

6.17 Statutory Rights

Nothing in this Section excludes, limits or affects any statutory rights that Members may have under Applicable Law.

Where any provision of this Section conflicts with a mandatory legal right, the mandatory legal right shall prevail.

Delivery & Customer Care

7. Delivery & Customer Care 

7.1 Dispatch Times

Swapkiddies aims to dispatch all completed Orders within three (3) to five (5) Working Days after the Order has been successfully placed and payment of any applicable delivery charges has been received. Dispatch times are estimates only and may occasionally vary due to operational requirements or circumstances outside Swapkiddies' reasonable control.

 

7.2 Delivery Methods

Orders may be delivered using Royal Mail, Evri or any other delivery provider selected by Swapkiddies.The choice of courier is entirely at Swapkiddies' discretion and may vary depending on the size, weight, destination or nature of the Order. Where available, tracking information will be provided to the Member after dispatch.

 

7.3 Delivery Time Frames

Estimated delivery times are provided for guidance only and are not guaranteed. Swapkiddies is not responsible for delays caused by postal operators, couriers, adverse weather conditions, industrial action or any other circumstances beyond its reasonable control. A delay in delivery does not automatically entitle a Member to compensation, a refund or additional SwapCoins.

 

7.4 Lost or Delayed Deliveries

If an Order appears to be lost or has not been delivered within a reasonable period, the Member should contact Swapkiddies as soon as reasonably possible. Swapkiddies will investigate the matter with the relevant delivery provider. Where a parcel is confirmed as lost during delivery after dispatch by Swapkiddies, Swapkiddies may, where appropriate:

a. replace the Item (if available);

b. restore the relevant SwapCoins to the Member's Account; or

c. provide another reasonable remedy at its discretion.

Members sending clothing to Swapkiddies remain responsible for those Items until they have been successfully delivered to Swapkiddies.

 

7.5 Incorrect or Damaged Orders

Members should inspect their Order promptly upon delivery. If an Order contains an incorrect Item, a missing Item or an Item that has been significantly damaged during delivery, the Member should notify Swapkiddies within seven (7) days of delivery. Swapkiddies will investigate the matter and, where appropriate, provide a suitable remedy, which may include replacement (where available), restoration of SwapCoins or another reasonable solution.

 

7.6 Delivery Address

Members are responsible for providing a complete and accurate delivery address during checkout. Swapkiddies accepts no responsibility for delays, failed deliveries or additional delivery costs arising from incorrect or incomplete address information supplied by the Member. Where an Order is returned because of an incorrect address provided by the Member, any additional delivery charges required to resend the Order must be paid by the Member before redispatch.

 

7.7 Customer Support

Members experiencing any issue relating to an Order or delivery should contact Swapkiddies as soon as reasonably possible using the contact details provided on the Website. Swapkiddies will make reasonable efforts to respond promptly and resolve genuine issues fairly and efficiently. Nothing in this Section limits any statutory rights that Members may have under Applicable Law.

Returns

8. Returns

8.1 Returning Unwanted Items

Swapkiddies does not offer cash refunds or exchanges for Items simply because a Member changes their mind, the Item does not fit, or it is no longer wanted. A Member who no longer wishes to keep an Item obtained through the Service may submit that Item to Swapkiddies as a new clothing submission, where it will be assessed in accordance with Section 5. Any returned Item will be assessed in accordance with the acceptance criteria set out in Section 5.

 

8.2 Return Procedure

Before returning an Item, the Member should notify Swapkiddies by email or through the contact details provided on the Website. Returned Items should be securely packaged and sent to the address provided by Swapkiddies.

 

8.3 Return Delivery Costs

I Unless otherwise agreed by Swapkiddies, Members are responsible for the cost of returning unwanted Items to Swapkiddies. Delivery charges paid when the original Order was placed are nonrefundable.

 

8.4 Assessment of Returned Items

All returned Items will be inspected using the same assessment process and acceptance standards that apply to all clothing submissions under Section 5. Acceptance of a returned Item is not guaranteed. Where a returned Item is accepted, one (1) SwapCoin will be credited to the Member's Account. Where a returned Item does not satisfy Swapkiddies' acceptance criteria, it will be treated as a rejected Item in accordance with Section 5 and may be donated, recycled or otherwise responsibly disposed of.

 

8.5 Faulty or Incorrect Orders

If a Member believes an Item received is incorrect, materially different from  the description on the Website, or has been significantly damaged before delivery, the Member should notify Swapkiddies as soon as reasonably possible. Swapkiddies will investigate the matter and, where appropriate, may provide a suitable remedy, including replacement (where available), restoration of SwapCoins, reimbursement of reasonable return postage, or another reasonable solution at its discretion.

 

8.6 Non-Returnable Circumstances

Swapkiddies will not accept returns solely because:

a. the Member has changed their mind;

b. the Item does not fit as expected;

c. colours or appearance differ slightly due to photography, lighting or screen settings;

d. the Item displays normal signs of careful secondhand use consistent with its description; or

e. the Item has been worn, altered, damaged or otherwise changed after delivery.

 

8.7 Nature of the Service

Members acknowledge that Swapkiddies operates as a clothing swapping service rather than a traditional retail business. The purpose of returning unwanted Items is to allow them to re-enter the Swapkiddies community through the normal clothing submission process, rather than to obtain refunds or compensation. Nothing in this Section limits or affects any statutory rights that Members may have under Applicable Law.

Safety Standards

9. Safety Standards

9.1 General Safety

Swapkiddies is committed to promoting the safe reuse of children's clothing. All Items accepted into the Service must comply with applicable product safety laws and regulations to the extent reasonably applicable to secondhand clothing. Items that do not meet Swapkiddies' safety requirements may be refused, removed from the Service or otherwise dealt with in accordance with these Terms.

 

9.2 Unsafe Items

Swapkiddies reserves the right to refuse, remove or dispose of any Item that, in its reasonable opinion, presents a health or safety risk. This includes, without limitation, Items that are contaminated, infested, mouldy, damaged in a manner that may create a hazard, or otherwise considered unsafe for reuse.

 

9.3 Product Safety Recalls

If Swapkiddies becomes aware that an Item has been subject to an official product safety recall or is otherwise identified as unsafe by a manufacturer or relevant authority, Swapkiddies may immediately remove that Item from the Service. Where reasonably practicable, Swapkiddies may contact any affected Member and take such action as it considers appropriate to protect Members and comply with applicable law.

 

9.4 Member Responsibility

Members are responsible for ensuring that any Item obtained through the Service is suitable for the intended child, including selecting the correct size, supervising its use where appropriate and using the Item safely and in accordance with any manufacturer's instructions or safety guidance.

Swapkiddies carries out reasonable inspections of Items before they are accepted into the Service. However, Members acknowledge that secondhand clothing may contain hidden defects that are not reasonably detectable during visual inspection. Acceptance of an Item does not constitute a guarantee that it is free from every defect or potential safety issue.

 

9.6 Reporting Safety Concerns

If a Member believes that an Item obtained through the Service presents a safety concern, they should notify Swapkiddies as soon as reasonably practicable using the contact details provided on the Website. Swapkiddies may investigate the matter and, where appropriate, remove similar Items from the Service or take any other reasonable action.

Members must use the Swapkiddies Website and Service in accordance with these Terms, Applicable Law and any reasonable instructions issued by Swapkiddies from time to time. Members are responsible for ensuring that their use of the Service is lawful and complies with these Terms.

Members must provide accurate, complete and up to date information when creating and maintaining their Account, placing Orders or communicating with Swapkiddies. Members are responsible for promptly updating any changes to their contact details, delivery address or other information relevant to the operation of the Service.

 

10.3 Lawful and Proper Use

Members must not:

a. use the Service for any unlawful or fraudulent purpose;

b. interfere with, disrupt or attempt to gain unauthorised access to the Website, its systems or security features;

c. misuse, manipulate or attempt to abuse the SwapCoin system or Membership Subscription;

d. use another person's Account without their permission; or

e. engage in any activity that may damage the reputation, operation or security of Swapkiddies.

 

10.4 Clothing Submissions

Members confirm that all Items submitted to Swapkiddies:

a. are lawfully owned by the Member;

b. are genuine and not counterfeit;

c. may legally be transferred to Swapkiddies if accepted;

d. comply with the requirements set out in Section 5; and

e. do not infringe the rights of any third party.

 

10.5 Respectful Behaviour

Members must communicate with Swapkiddies in a respectful and courteous manner. Abusive, threatening, discriminatory, offensive or harassing behaviour towards Swapkiddies, its representatives or other Members will not be tolerated and may result in suspension or termination of the Member's Account.

 

10.6 Suspension or Termination

Where a Member breaches these Terms, engages in fraudulent activity, misuses the Service or otherwise acts in a manner that may harm Swapkiddies or other Members, Swapkiddies may, acting reasonably:

a. suspend or terminate the Member's Account;

b. cancel or refuse Membership renewal;

c. refuse future clothing submissions or Orders; and

d. take any other reasonable action permitted by these Terms or Applicable Law. Where appropriate, Swapkiddies may do so without prior notice.

 

10.7 Account Security

Members are responsible for maintaining the confidentiality of their Account login details and password. Members must notify Swapkiddies immediately if they become aware of any unauthorised access to their Account or any suspected security breach. Members remain responsible for activity carried out through their Account unless and until Swapkiddies has been notified of unauthorised use.

 

10.8 Cooperation

Members agree to cooperate with Swapkiddies where reasonably requested in connection with investigating suspected fraud, misuse of the Service, breaches of these Terms or compliance with Applicable Law. Failure to provide reasonable cooperation may result in the suspension or termination of the Member's Account where appropriate.

By submitting such content, the Member grants Swapkiddies a nonexclusive, worldwide, royalty free licence to use, reproduce, edit, publish and display that content for the purpose of operating, promoting and improving the Service.

 

11.6 Third-Party Rights

Members must not upload or submit any material that infringes another person's copyright, trademark, privacy rights or any other intellectual property rights. Swapkiddies reserves the right to remove any content that it reasonably believes infringes the rights of a third party.

Swapkiddies makes reasonable efforts to identify damaged or unsuitable Items before they are accepted into the Service. However, some defects may not be visible during a reasonable inspection. Swapkiddies does not guarantee that every hidden defect or potential safety issue will be identified before an Item is supplied.

 

12.4 Member Responsibility

Once an Order has been delivered, Members are responsible for inspecting the Items received, ensuring they are suitable for the intended child and using them safely and appropriately. Members should always follow any manufacturer's care instructions or safety guidance where available.

 

12.5 Circumstances Outside Swapkiddies' Control

Swapkiddies shall not be responsible for delays, interruptions or failures resulting from circumstances beyond its reasonable control, including but not limited to postal or courier delays, technical failures, internet outages, acts of nature, industrial disputes, governmental action or inaccurate information provided by Members.

 

12.6 Limitation of Liability

To the fullest extent permitted by Applicable Law, Swapkiddies shall not be liable for any indirect, incidental or consequential loss, including loss of opportunity, inconvenience, disappointment or any similar loss arising from the use of the Service. Where Swapkiddies is legally responsible for an issue relating to the Service, its liability may, where appropriate, be limited to one or more of the following remedies:

a. replacing the affected Item (where available);

b. restoring the relevant SwapCoins to the Member's Account;

c. refunding any applicable delivery charges where required by Applicable Law; or

d. providing another reasonable remedy at Swapkiddies' discretion.

Nothing in these Terms excludes, restricts or limits any liability that cannot legally be excluded under Applicable Law, including Members' statutory consumer rights. Where any provision of these Terms conflicts with a mandatory legal right, the mandatory legal right shall prevail.

THE SWAPKIDDIES GIFT CARD POLICY 

1. Gift Card Use

Swapkiddies Gift Cards can only be purchased and redeemed through the Swapkiddies website.

Gift Cards may be purchased as a gift for someone else or redeemed by the purchaser to add SwapCoins to their own Swapkiddies account.

Gift Cards are available in denominations of £20, £30, £40 and £50 and are delivered electronically by email with instructions for redemption.

 

2. Redemption

Gift Cards can only be redeemed to purchase SwapCoins.

They cannot be:

  • exchanged for cash;

  • refunded once redeemed;

  • resold;

  • used to purchase another Gift Card.

Each Gift Card can only be redeemed once and cannot be reloaded or reused after redemption.

 

3. Redeemed SwapCoins

Once a Gift Card has been redeemed, any SwapCoins added to a Swapkiddies account are subject to the standard Swapkiddies Terms & Conditions, including the SwapCoin expiry policy and membership rules.

 

4. Validity

Gift Cards are valid for 12 months from the date of purchase.

Any Gift Card that has not been redeemed before its expiry date will become invalid and cannot be refunded, extended or reactivated.

 

5. Cancelled Orders

If a purchase made using a Gift Card is cancelled before it has been fulfilled, the redeemed value will be returned to the recipient's Swapkiddies account as SwapCoins or account credit (where applicable) for future use. This does not affect your statutory rights.

 

6. Lost or Unauthorised Use

Please treat your Gift Card like cash.

Swapkiddies is not responsible for lost, stolen or unauthorised use of Gift Cards and cannot replace or refund Gift Cards once they have been redeemed.
